DENIAL & SUSPENSION OF PRIVILEGES POLICY
ADOPTED: July 15, 2000
REVISED: March 28, 2005
WHEREAS, the Jefferson County Library District desires to
protect the health, safety, and security of its patrons and staff as
well as ensure the efficient operation of the library district while said
patrons use its facilities.
WHEREAS, a written policy of denying access to patrons under certain
circumstances is necessary.
NOW THEREFORE, the Board of Directors of the Jefferson County Library
District adopts the following policies and procedures for denying and
suspending access to the library to patrons:
- An immediate denial and suspension of privileges may be issued by the
library manager, if on duty, or the designated library employee if the
library manager is not on duty, to a patron for unacceptable behavior, to
preserve evidence from an occurrence of unacceptable behavior, and/or to
maintain the peaceful atmosphere of the library.
A. Unacceptable behavior includes but is not limited to:
- The disruption of the quiet enjoyment of the patrons in the use of
the library’s services and facilities.
- The use of the computers in a manner not in conformance with the
Jefferson County Library Public Internet and Computer Acceptable Use
Policy.
- Any behavior, which may endanger the health and safety of the
library’s patrons and/or staff.
- Any behavior, which may damage the property of the library or the
property of the library’s patrons and/or staff.
- Any violation of the library district's policies, procedures, or
guidelines.
B. The length of an immediate denial of privileges and
suspension shall not exceed five days after the library business day for
which the suspension or denial of privileges is issued. The length of
the suspension is to be determined by the library manager or the
designated library employee. Said length of suspension is to allow for
review of the incident by the library manager and to allow the library
manager adequate time to request further action from the library
director if deemed appropriate.
The library manager, or the designated library
employee, shall complete an incident report upon any issuance of an
immediate denial or suspension of library privileges. Said report shall
contain the facts surrounding the incident including, but not limited to any
policies violated, manner of said violation, the name, address, and
telephone number of the patron and all witnesses, and any other pertinent
information regarding the incident and/or patron. In the event the patron
who is committing unacceptable behavior has not or will not identify
himself, has not signed in, and is not known by library employees, then at
least two employees shall attempt to observe patron for identification
purposes.
- Intermediate or Indefinite Suspension
A. An intermediate or indefinite suspension of the library
privileges may be issued by the Director of the Library District or
Director’s designee at the written request of the library manager due to
the seriousness of the incident or because of an ongoing problem with
the patron. In determining whether or not to issue an intermediate
suspension and the intermediate length or to issue an indefinite
suspension the director will consider the following:
- The number of violations of library policy by the patron
- The facts of one or more incidents which indicate the patron’s
intent to violate library use policies.
- Whether the conduct included moral turpitude meaning, an act or
behavior that gravely violates moral sentiment or accepted moral
standards of the community but not necessarily prohibited by law.
- Whether the incident included damage to the property of the
library or of a library patron or personal injury to a library
employee or patron.
B. The library director or designee will notify the patron in writing
of the length of the suspension, the reasons for suspension, and the
appeal policy.
C. A patron may appeal the issuance of an intermediate or indefinite
suspension. Said appeal must be made in writing to the director of the
library no later than 15 days after the date of the written notice of
suspension. The director or designee of the library will respond to the
written appeal no later than 15 days after receipt.
D. In the event the library director or designee upholds the
suspension, the patron may appeal to the Jefferson County Library Board
of Trustees in writing no later than 30 days after the date of the
Director’s denial.
E. The patron may petition the Board of Trustees to review his/her
indefinite suspension on an annual basis in the following manner: The
suspended patron will file a written petition stating the patron’s name,
address, and current telephone number, the date the patron’s indefinite
suspension began, the change in circumstances which demonstrate that the
patron’s library privileges should be reinstated, and other information
the patron feels is pertinent to the matter.
